- Complain to the trader in writing → First. Always start here — many problems get fixed at this step.
- Chargeback, Section 75, or an ombudsman/dispute scheme → Middle. Free routes that often work, before going to court.
- Letter before action → Middle. The final warning before court.
- Start a small claim → Last resort. The last step, when everything else has failed.
- Fact: “Small claims in England and Wales can usually be started online.” — There's an official online service for money claims.
- Myth: “Winning a court claim guarantees you'll actually get the money.” — If the business has no money or ignores the judgment, you may need further enforcement steps (with extra fees).
- Fact: “Scotland's equivalent of small claims is called 'simple procedure'.” — Different name, similar idea. Northern Ireland has its own small claims process too.
